Advanced Pre-Registration Detection Tool Released

We have spent months creating the “Who’s It Gonna Be” Tool. No longer will intellectual property attorneys need to track down offenders of trademarks in domain names. The technology is roughly based around the Psychic Whois system we released last year. The new system stops all trademark registrations before they happen. The technology uses proprietary algorithms and millions of whois queries and extensive history to come up with predictions on who will register any given domain name in the future. The system will email challenging lawyers prior to the registration of a domain to let them know they may want to object to the registration prior to it actually getting registered. They can either register the domain before the offending registrant or they can choose to take the registrant to court to stop them. If the registrant is not alerted by an attorney prior to the registration, they are guaranteed that the domain is trademark-free and that no one will sue them over the domain.
Our technology is now so good we believe we can predict what people will registered about 36 hours before they commit the crime. This is clearly a win-win for everyone involved in the domain industry. There will no longer be squatters and only true domainers will be registering new domains. Attorneys will be able to send out “cease and desist” letters to suspected registrants to keep them on their toes. “This is keeping us one step ahead of the bad guys” said an IP attorney who wished to remain anonymous. The tool will likely cause a serious outcry in the domainer community but eventually everyone should accept it. Lawyers have begun private beta testing of the service two months ago and it will be released to everyone later this week. ICANN has indicated this new, “Who’s It Gonna Be” technology will allow them to form a new UDPRP (Uniform Domain Pre-Registration Policy). Cases will be more proactive than the current UDRP. We’re happy we can assist ICANN in making the world safer one domain at a time.

I think this is shocking and is something that you should seriously reconsider. You would be FOOLISH to release this - just think of the abuse potential. Instead of protecting legitimate trademarks, it would be possible for a trademark troll to work out what domain registrations were upcoming and then file for a trademark in advance!!!1! It’s completely unethical and very dangerous.

HEY, Jay, Be CAREFUL out there … I know it’s only a joke (this time) but as we all know, there are forces out there that would LOVE to implement this type of program and make it a reality.
And it would tie-in nicely with the infamous “Snowe bill” looming on the horizon.
Today’s joked-about product could be a Politician’s darling new technology to ’save us from ourselves’.

Ya i wonder if somebody thought this was an April fools joke as well…i HOPE it was but somehow i just think its the continuing nightmare of overreaching boundaries sorry im a big ole Dinosaur im still stuck on the fact a company can trademark a sound …hmm ya know a good trademark lawyer ought to contact all the religious leaders of the world and file class action suit against the trademark holders of the world stating that since GOD created the universe and all things in it they are infringing on his trademark (trademarking human genes ok since humans are millions of years old dont their genes fall under the public domain )

Deutsche Telekom / T-Mobile demands Engadget Mobile discontinue using the color magenta

So last week Deutsche Telekom, owners of the global T-Mobile brand, sent Engadget a late birthday present: a hand-delivered letter direct from their German legal department requesting the prompt discontinuation of the use of the color magenta on Engadget Mobile. Yep, seriously.
Granted, we get nastygrams from angry tech companies practically every day, but rarely regarding anything that’s not some piece of news we published that they’re livid about having out in the open. And irony of ironies, this whole use-of-magenta thing is precisely the topic we took up last year on behalf of DT.
We spoke with David Beigie, vice president of corporate communications for T-Mobile US, who offered: “As a trademark owner, from time to time Deutsche Telekom looks at usage that could lead to confusion in the marketplace. The letter sent by DT merely outlines these perspectives and is meant to simply open a dialogue. Engadget continues to pioneer forums for discussion of wireless industry developments and innovation. T-Mobile respects the role Engadget and its readers play in advancing dialog on these important topics.”
So in the interest of that open dialog we’ve posted Deutsche Telekom’s letter below, as well as a handy guide to allay any confusion should you suddenly find yourself disoriented and trying to buy your next SideKick or MDA from Engadget Mobile.
