Trademark Domains and Free Speech Sites

Great video today. I had someone ask about this exact type of thing just today. Free Speech is protected and Yes you can use a Trademark in your domain. Read these comments on this post, they talk about this issue. It was nice to see my friend Milton Mueller in the video answering some of the questions. I had no idea he was involved in this case. This is a very well done video. Great editing work.

When you own a business, you will feel the pain in protecting your names. People like this SUCKS.

Hi, Jay, I was going to send you an email, but I couldn’t find your address. (Is it here somewhere and I just missed it? If so, sorry about that.) So I decided to post this as a comment instead. It’s just a quick note to thank you for linking to the “Taubman Sucks” video. It was my first-ever posting on YouTube, and I had no idea what to expect — I half expected it to be ignored, but I’m glad that it hasn’t been.
FYI, I’ve linked back to your blog from a page on my site (http://www.TaubmanSucks.com/blogs.html) that lists the blog postings that have been written about the TaubmanSucks case.

This is good news for all fan sites out there
, but I really hope that everyone that are victims of look-a-like sites trying to profit on other business names still will have a chance in winning domain name disputes.

UPDATE BY JAY: I don’t think this is a case of a look-a-like site. Hank’s original site was designed to showcase something he liked and believed in. No different then collecting stamps and building a site about them. As long as the site doesn’t cause confusion in the public it is fine. There is a disclaimer on the site and they make it very clear.

There are 2 sides to the Cybersquatting/Trademark battle BOTH have valid points and BOTH have unscrupulous factions that give their side a bad name its up to the rest of us to try and be level headed and try to stand up for what is right but also remember that if loopholes exist in rules and can be used doesnt always make the people bad just playing the game by the rules the way they are we need to get together and make New Rules that can give some protection to both sides Trademarks deserve protection but they dont own every use of a term and anybody that makes or sells stuff that is counterfit or makes like they are another company in question is wrong should be punished if they did it knowingly on ebay right now is the Domain name BYEDomains.com
the guy states not to be confused with BuyDomains.com
or is it ? that to me (besides being a UDRP/Lawsuit waiting to happen)isnt cool and my minds open more than most but thats just my opinion.I Guess this is why it will be a long hard fight to a solution.you
know id like to see if we who are or consider themselves Domainers could even agree on some of the Domain cases now thats a Opinion Poll id like to see

Ok now here are IDIOTS being hippocrits(sorry if spelled wrong i cant spell) and stupid at the same time i saw a video on a group that has Cybersqatted the Democratic National Convention 2008 with like 14 Domains around the real one (lookalike domains)and have loaded them with their own Anti-Capitolistic tripe (well ok im a Capitolist i admit it)but get this they didnt do it to just exert freedom of speech they did it to sell to the Democrats!!! the guy said it in an interview to a reporter to feed the homeless…Great cause but it just puts another bad taste in peoples mouths about people who register Domains Jay maybe you can post it(story is out of Denver CBS affiliate ch4 i believe) here to show the report since it is a high profile Cybersquatting issue ,i didnt want to post the the link i have i dont know what its linked to besides the story.We
all make mistakes and have said it depends how a Domain is Used even with a loophole but to buy to sell in this fashion looks like this is BAD FAITH DARKSIDE DOMAIN USE IMHO whats all of yours?

Taubman Sucks deserves two thumbs up! Thank you for sharing your experience in such an informative and engaging manner. Each step of the way, I felt a piece of your emotions as you told your story. I was not familiar with your case prior to watching the video, so right up until the end I anxiously waited to see how things would unwind. Congrats to you and your Dream Team.
